This website is operated by Very English Limited (referred to as “Very English/ we/ us/ our”) By using our website and/or making any transactions on the website you (referred to as “you and your”) acknowledge your acceptance of our Terms and Conditions. Please read through these Terms and Conditions carefully before using the website.
General Terms:
We may change the Terms and Conditions of the website at any time to take effect at the point that they are posted on the website. Your use of the website will signify that you accept the latest Terms and Conditions posted on the website at the time you are using it. If you are not using the website as a consumer, by using the site, you confirm that you have the authority of the business on whose behalf you are using the site. Where you are required to use a password or login to access any area of the website, you must keep the password and login details strictly confidential. If you are concerned that this confidentiality has been compromised or the password and/or login has been misused, you must let us know immediately.
When you place an order with us, it will be deemed that you have read, understood and agreed the Terms and Conditions. If you have any queries please contact us directly (we are ever so nice to chat to!) before placing your order. We will be happy to answer any of your questions. By placing your order you are making an offer to us to purchase the goods in your order. To process your request or inform you of our acceptance of your order, we will need the following details: Your name, address, email address and telephone number. We may pass on your telephone number to our couriers unless you inform us that you don’t want us to do so. We will send you an email to confirm receipt of your order. This is not acceptance of your order. A contract between us will only exist once your order has been accepted, processed and sent out to you. We reserve the right to reject your offer for purchase at any point and, as we are sure you will understand, we will be unable to meet any obligations in respect of the order the following circumstances: 2.4.1 If we are unable to authorise your payment. 2.4.2 If there is a product description or pricing error. 2.4.3 If (as a result of exceptional conditions) our delivery companies are unable to deliver the goods to you. If any product you have ordered is out of stock or unavailable.
Prices and Payment
3.1 Prices are based on Pounds Sterling and are inclusive of VAT at a rate of 20%. Prices are per item unless otherwise stated and exclude delivery charges. Please note that potential customs fees, taxes and/or duties are not included in item prices or delivery prices but are your own responsibility. 3.2 International delivery is available on some goods. Delivery will be charged on the basis of delivery prices from time to time based on the size of package and its destination. If the weight of the package is heavier after the goods have been packaged, we reserve the right to request additional funds to cover the costs of the delivery. Please note that potential customs fees, taxes and/or duties are not included in item prices or delivery prices but are your own responsibility. 3.3 The price displayed on the website is the price you pay at the time we receive your order request except in the case of a price error. If we discover that there has been a price error, we will notify you as soon as possible and provide you with the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you about the order, we will cancel the order. If you have already paid for the product and choose to cancel your order in light of the price error, you will receive a full refund. Sorry!! 3.4 All goods will remain our property until your full payment has been received and verified. All goods are subject to availability. In the event that we are unable to supply the goods we will let you know about this as soon as possible. In the event that payment has already been made for the goods, a full refund will be made. Returns And Refunds
4.1 We offer a full 14-day money back guarantee on all of our products provided they are returned to us unused, and in their undamaged original packaging. Before returning an item, please contact us by email at hello@veryenglish.co.uk. The goods will be your responsibility until they reach our warehouse so please ensure that you package them very carefully to prevent damage to the items or their packaging. Of course, this returns policy does not affect your statutory rights. 4.2 Unless a returned product is faulty, we will not pay for the costs of return postage. We recommend you return the product via registered post or through a courier service that supplies a proof of postage so that you are able to seek recourse from the Royal Mail or your courier should the parcel fail to reach us. Where the returned item is returned from overseas, you will be responsible for any customs fees, taxes or duties arising. 4.3 In the unlikely event that your goods arrive damaged or faulty, or where a manufacturing fault occurs within six months of purchase (but obviously not as the result of normal wear and tear) please contact our customer service team by email at hello@veryenglish.co.uk supplying a photograph of the damage or fault, so that we can arrange a replacement, exchange or refund for you. 4.4 Very English are not responsible for any interest charges made by your credit card company whilst waiting for refunds to your account on any returns. 4.5 All orders will be refunded in £ Sterling. Very English will not be responsible for any changes in exchange rate and any losses that result from such exchange rate changes. 4.6 All returns should be made to Returns Department, Very English Limited, 2 Chene Mews, St Albans, Hertfordshire, AL3 5QF.
Whilst we will make every effort to deliver the goods to you within estimated timescales (3-5 days for UK post or courier, and longer for International post), delays are sadly occasionally inevitable. Very English will not be liable for any delay or failure to deliver the Goods to you within the estimated timescales.
Intellectual Property
The content of all pages on our website, shop and blog including pictures, photographs, written copy and other materials, are the copyright or registered trademark of Very English, our providers, contributors or licensors. You are very welcome to use this material for your personal, non commercial use and may download the material and content for the sole purpose of using this website. However, any other use (including copying, reproducing, transmitting, commercially exploiting, distributing or displaying) of the material and content of this website is prohibited unless you first obtain our written approval. This may be given in writing at our discretion but only if you reference us clearly as copyright and trade mark holders and link to the home page of website in each instance of such pre-authorised use.
Liability and Indemnity
Nothing in these Terms or Conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability that cannot be limited or excluded under applicable law. 7.2 Subject to Section 7.1 above, we will use reasonable endeavours to verify the accuracy of any information on the site but make no representation or warranty of any kind, express or implied, statutory or otherwise, regarding the contents of the site. Very English will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and we accept no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.   7.3 Subject to Section 7.1 above, other than as expressly provided in these terms and conditions with respect to specific products and except for the exclusive remedies set out at Section 4 above, any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law.   7.4 Subject to Section 7.1 above, Very English will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any: •economic losses (including without limitation, loss of revenues, data, profits, contracts, business or anticipated savings); or • loss of goodwill or reputation; or • special or indirect losses suffered or incurred by you or any other party arising out of or in connection with the provisions of any matter under these terms and conditions.   7.5 Notwithstanding the above, subject to Section 7.1 our aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.   7.6 This clause 7 does not affect your statutory consumer, nor does it affect your rights to cancel the contract.   7.7 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
